GOOD NEWS – THE NEW MEXICO SUPREME COURT AGREES TO REVIEW THE NAVAJO WATER CASE

On August 13, the Water Users received good news from the New Mexico Supreme Court. The state’s highest court agreed to hear the Water Users’ challenges to the lower court rulings in favor of the Navajo Nation. The Supreme Court has the power to overrule all of the lower court decisions, or to reverse any errors it finds in them. This means that all of the Water Users challenges to the Richardson-Navajo settlement are still alive.

The Supreme Court also agreed to hear the objections filed by Gary Horner, Rick Tully, and Priscilla Shannon on behalf of individual water owners. The Court will also hear the objections filed by the New Mexico State Engineer, the Albuquerque Bernalillo County Water Authority, and the City of Gallup.

The Supreme Court said that it will issue an order setting a schedule for hearing the case. We will let you know the timetable as soon as the court issues one.
